Explicit or Implied Consent Using Nexus AI™ Scribe
You are responsible for the collection of consent from the patient.
The scribe defaults to an implied consent system where it will not automatically prompt you to obtain the patient’s consent for each encounter. If you or your clinic would like to have the scribe prompt for consent ahead of each patient encounter, please enable explicit consent.
How to Customize Your Consent Settings
To switch your consent settings, click on the three bars at the top left of the application and navigate to the Settings section.
Under Consent Preset, switch from “Implied Consent” to “Explicit Consent”. Once changed, you need to scroll all the way to the bottom and click the “Save All Settings" button. If you want to change the settings back, you can use this section to switch between the consent options.
How Can I Obtain Consent?
You need to capture consent from the patient if you are capturing their voice for the purposes of automated note-taking, which includes using Nexus AI™ to process your patient’s personal information (including personal health information) as part of the services.
Consent can be gathered from a patient verbally; this can be done by explaining to them why you want to have the scribe listen to the encounter and how it is helpful. You can mention how the data stays within Canada, so that you can focus on listening to them while the scribe takes care of writing a note, or how it can save you both time. If they approve of your use of the scribe, then you have obtained their explicit consent and can use it. On subsequent visits by the same patient, you can check with them to confirm if they still consent to the use of the scribe. Alternatively, you can choose to capture consent from the patient using a patient intake form, such as OceanMD, which accurately explains how the patient’s data will be collected and used by Nexus AI to save you the time of informing and tracking consent.
Whether you collect consent verbally, physically, or through a digital patient intake form, such consent needs to be saved within the patient’s record.
